These Terms & Conditions (“Terms”) govern your use of the services, products, and website offered by Overcoming Anxiety, operated by Dawn Morgan as a sole trader, based at Calle Cruces 23, Galera, 18840 Granada, Spain (“I”, “me”, “my”).

By purchasing, accessing, or using any of my services, including hypnotherapy, coaching, courses, programs, digital content, subscriptions, memberships, or materials (together, “Services”), or by using the website located at overcominganxiety.now (“Website”), you agree to be legally bound by these Terms.

If you do not agree to these Terms, you should not purchase or use the Services or the Website.


1. Scope of Services

1.1 I provide hypnotherapy, coaching, educational programmes, group and individual sessions, online courses, digital products, and related content focused on anxiety and personal development.

1.2 All Services are intended to support wellbeing, personal development, and education. They are not a substitute for:

medical advice, diagnosis, or treatment

psychotherapy, counselling, or psychiatric care

any treatment by a qualified healthcare professional

1.3 I am not a medical doctor, psychiatrist, or psychologist. You should always consult your GP or relevant healthcare professional regarding any medical or mental health concerns.

1.4 Age restriction:
Services are offered only to individuals aged 18 or over. By booking or purchasing Services, you confirm that you are at least 18 years old.

1.5 You agree to provide accurate, complete information when booking or registering for any Services.


2. Contract and Payment

2.1 When you book, purchase, or access Services, you enter into a contract with me, Dawn Morgan, trading as Overcoming Anxiety, as a sole trader.

2.2 All fees are payable in advance unless otherwise agreed in writing. Prices and currencies will be clearly stated at the point of purchase or booking.

2.3 Payments are processed securely via third‑party payment providers (for example, Stripe, PayPal, or bank transfer, as applicable). I do not process or store your full card details.

2.4 Your booking or access to digital content is not confirmed until payment has been received (unless I have explicitly agreed other arrangements in writing).

2.5 I reserve the right to change prices at any time. Any change will not affect Services that have already been paid for.


3. Refunds, Cancellations & Cooling‑off

3.1 Refund and cancellation terms may vary depending on the specific Service (e.g. 1:1 sessions, group programmes, memberships, or online courses). Any special or additional terms will be explained on the relevant booking or product page and/or in your confirmation email.

3.2 Unless otherwise stated in writing for a particular Service:

Individual sessions (online or in person)

Cancellations or rescheduling with at least 24 hours’ notice:
The session fee may be transferred to a new appointment time.

Cancellations with less than 24 hours’ notice or failure to attend:
The full session fee is normally non‑refundable.

Packages, group programmes, memberships, and multi‑session offers

If you wish to cancel before the first session or before accessing any course content, you may request a refund, which will be considered in line with any statutory cooling‑off rights and applicable law.

Once sessions have been taken or digital content accessed, only the unused portion (if any) may be considered for a partial refund, and this is at my discretion, taking into account the time, preparation, and materials already provided.

3.3 Digital content and online courses (e.g. recordings, downloads, self‑paced programmes, members’ area content):

Where digital content is delivered immediately or access is granted straight away, you acknowledge that by accessing or downloading the content you lose any statutory right to cancel that might otherwise apply to unopened/unused digital content.

Unless otherwise expressly stated, digital content is non‑refundable once accessed.

3.4 I may, at my discretion, provide a voluntary refund or credit in circumstances not covered above, but this is not guaranteed.

3.5 If I need to cancel or reschedule a session, event, or programme:

I will give you as much notice as reasonably possible;

you will be offered an alternative time or equivalent access; and

if a suitable alternative cannot be found, I may offer a refund for the affected session(s) or part of the Service.


4. Client Responsibilities

4.1 You are responsible for your own wellbeing, choices, and decisions at all times, both during and after any session, course, or programme.

4.2 You agree to:

provide honest and accurate information about your health, medication, and any diagnoses when asked;

inform me promptly of any changes in your physical or mental health that might affect our work;

consult your doctor or relevant specialist before starting or continuing hypnotherapy or coaching if you have any concerns about your suitability.

4.3 If you are currently under the care of a medical or mental health professional, you may wish to inform them that you are undertaking hypnotherapy or coaching. In some cases, I may ask for your GP or specialist’s details, and/or your consent to contact them where this is appropriate and in your best interests.


5. Intellectual Property

5.1 All materials, recordings, written content, videos, worksheets, course materials, branding, and resources provided as part of the Services or available through the Website are the intellectual property of Dawn Morgan, trading as Overcoming Anxiety, unless otherwise stated.

5.2 You are granted a personal, non‑transferable, non‑exclusive licence to use these materials for your own personal use only.

5.3 You may not, without my prior written permission:

reproduce, copy, modify, share, sell, or distribute any content or materials;

republish or upload materials to the internet, including social media or file‑sharing platforms;

use my content for your own commercial or professional purposes (such as in your own business or practice).

5.4 Any unauthorised use of my materials may result in legal action and/or termination of your access without refund.


6. Website Use

6.1 You agree to use the Website overcominganxiety.now in a lawful way and not to:

engage in any activity that disrupts or interferes with the Website;

attempt to gain unauthorised access to any part of the Website, server, or systems;

use the Website to distribute spam, malware, or unlawful content.

6.2 I do not guarantee that the Website will be available at all times or free from errors, although I aim to maintain reasonable levels of availability and security.


7. Disclaimer & Limitation of Liability

7.1 My Services are intended as complementary support and for personal development. They do not provide:

medical diagnosis or treatment

emergency or crisis mental health services

legal, financial, or other professional advice

7.2 Results vary from person to person. I do not guarantee specific outcomes, such as complete removal of anxiety, particular life changes, or financial or professional results.

7.3 You agree that you are responsible for your own decisions, actions, and results, and that you will seek appropriate medical or professional support where needed.

7.4 To the maximum extent permitted by applicable law, I am not liable for:

any loss, damage, or injury (direct or indirect) arising from your use of the Services, Website, or reliance on any information provided;

any indirect, consequential, or special loss, including loss of income, profits, opportunities, or data.

7.5 Nothing in these Terms excludes or limits liability where it cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.


8. Health, Safety & Suitability

8.1 Hypnotherapy, coaching, and related Services may not be suitable for everyone. Certain conditions (for example, some types of psychosis, severe or unmanaged mental health conditions, or particular neurological conditions) may mean that these Services are not recommended.

8.2 I reserve the right to decline or discontinue Services if I believe they are not suitable or safe for you, or if I believe you require a different form of support or specialist care.

8.3 In an emergency or mental health crisis, you must contact your local emergency services, doctor, or crisis support service. I do not provide emergency or crisis services.


9. Age Restriction

9.1 Overcoming Anxiety Services and the Website are intended for adults aged 18 and over.

9.2 I do not knowingly provide Services to, or enter into contracts with, individuals under 18 years of age.


10. Governing Law & Jurisdiction

10.1 These Terms and any dispute or claim arising out of or in connection with them (including non‑contractual disputes or claims) shall be governed by and construed in accordance with the laws of Spain.

10.2 The courts of Spain shall have exclusive jurisdiction over any dispute or claim arising from or related to these Terms, the Services, or the Website.


11. Changes to Terms

11.1 I may update or amend these Terms from time to time to reflect changes in the law, my Services, or my business practices.

11.2 The most current version will be posted on the Website with the “Last Updated” date. Continued use of the Services or Website after changes take effect constitutes your acceptance of the updated Terms.
